1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pitkevics IT Services, operating as Vibe Coding Starter Kit ("Company", "we", "us", or "our"), a company registered in Norway.

By accessing our website at vibecodingstarterkit.io or purchasing our products, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or purchase our products.

2. Products and Services

2.1 Description

Vibe Coding Starter Kit is a software development toolkit and boilerplate code package designed to help users build web applications. The product includes source code, documentation, templates, and related digital materials.

2.2 Delivery

Upon successful payment, you will receive access to the product via email or through our designated delivery method. Digital products are delivered electronically and are available immediately after purchase.

2.3 Updates

Your purchase includes access to future updates of the product at no additional cost. We reserve the right to modify the scope and frequency of updates at our discretion.

3. License Grant

3.1 License Scope

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to:

• Use the product to create unlimited personal and commercial projects
• Modify the source code for your own use
• Use the product for client work and freelance projects

3.2 Restrictions

You may NOT:

• Resell, redistribute, or share the product with others
• Create derivative products for sale that compete with Vibe Coding Starter Kit
• Share your license or access credentials with third parties
• Remove or alter any copyright notices or attributions
• Use the product in any way that violates applicable laws

4. Payments and Pricing

4.1 Pricing

All prices are displayed on our website and are subject to change without notice. Prices are in USD unless otherwise stated. Any applicable taxes (including VAT for EU customers) will be calculated at checkout.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your payment card details on our servers.

5. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of your purchase date.

• Refunds are processed within 5-10 business days

Upon receiving a refund, your license to use the product is immediately revoked, and you must delete all copies of the product in your possession.

6. Intellectual Property

The product, including all source code, documentation, designs, and related materials, is owned by Pitkevics IT Services and is protected by copyright and other intellectual property laws.

Your purchase grants you a license to use the product as described in Section 3, but does not transfer any ownership rights to you.

7. Disclaimer of Warranties

The product is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or completeness of content

We do not warrant that the product will meet your specific requirements or that any errors will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Pitkevics IT Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute products or services
• Any other commercial damages or losses

Our total liability for any claims arising from or related to these Terms or the product shall not exceed the amount you paid for the product.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pitkevics IT Services and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the product or violation of these Terms.

10. User Conduct

When using our website and products, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our website
• Use automated systems to access our website without permission

11. Third-Party Services

Our product may integrate with or require third-party services (such as Stripe, Supabase, or Vercel). Your use of such services is subject to their respective terms of service and privacy policies. We are not responsible for the availability or functionality of third-party services.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our products after such modifications constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:

• Your license to use the product is revoked
• You must delete all copies of the product
• Provisions that by their nature should survive will remain in effect

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the product shall be subject to the exclusive jurisdiction of the courts of Norway. However, for EU consumers, mandatory consumer protection laws of your country of residence may also apply.

15. Consumer Rights (EU/EEA)

If you are a consumer in the European Union or European Economic Area, you have certain rights under EU consumer protection laws. These Terms do not affect your statutory rights.

For digital content, you acknowledge that by receiving immediate access to the product upon purchase, you waive any right of withdrawal that may otherwise apply under EU law. However, our 30-day refund policy provides equivalent or greater protection.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pitkevics IT Services regarding the use of our products and supersede any prior agreements.
